Drive & Shine – Liability Disclaimer

Before accepting the Smart Watch gift (”Gift”) as part of the Drive & Shine – Vehicle Wrap Advertising Reward Program (the “Program”) offered by Digital Cash Cowboy Inc. (”The Company”), you (the “Recipient”) must confirm that you have read, understood, and accepted all terms and conditions of this liability disclaimer.

Gift Acceptance: The Recipient acknowledges that accepting the Gift is completely voluntary and that they understand and agree to assume any risks that may arise from the use of the Gift, including but not limited to property damage, personal injury, and other forms of loss. The Recipient understands and agrees that the Company is not responsible for any risks arising from the acceptance or use of the Gift.

Quality and Performance of the Gift: The Company makes no express or implied warranties or representations regarding the quality, performance, applicability, or other aspects of the Gift (Smart Watch). The Gift is provided “as is” without any form of warranty, and the risk of use is entirely borne by the Recipient.

Waiver of Legal Claims: The Recipient hereby expressly waives all present and future legal claims against the Company and its affiliates, directors, officers, employees, agents, suppliers for any damages, losses, costs, or expenses (including but not limited to property damage, personal injury, death, and legal fees) arising from or related to the acceptance or use of the Gift.

Liability Exemption: The Recipient agrees that the Company and its affiliates, directors, officers, employees, agents, suppliers will not be liable for any direct or indirect damages, losses, costs, or expenses, including but not limited to property damage, personal injury, death, legal fees, arising from or related to the acceptance or use of the Gift.

Compliance: The Recipient is responsible for ensuring that their actions comply with all applicable laws, regulations, and rules, including but not limited to the use of the Gift (Smart Watch).

Final Interpretation: The Company reserves the final interpretation right of the Gift and this disclaimer. The Company has the right to make the final decision in case of any dispute regarding the conditions of the Gift.

By participating in the Program and accepting the Gift, the Recipient acknowledges and confirms they have read, understood, and agree to the terms and conditions outlined in this disclaimer. The Recipient further acknowledges and confirms they have had ample time and opportunity to seek independent legal, financial, or tax advice, if they wish, to help them understand this disclaimer.
